Legal Paternity Test—This DNA test is designed to be presented as evidence in court proceedings. This test does not need to be court ordered. There is absolutely no difference between the personal test and the legal test in terms of the methods involved in the DNA analysis.  The main difference is in order for the test to able to stand up in court, legal counsel, judges and a jury must be confident that:

  1. Evidentiary samples were collected properly, therefore a strict “chain-of-custody ” must be established.
  2. That an accredited laboratory, using sound procedures, performed the tests and analyzed the results accurately.

Chain of Custody:
The chain of custody is basically a documentation procedure that will establish the identity of the individuals being tested.  In order to establish the chain of custody, we will have an independent person acquire the DNA sample in a laboratory in your area. This independent person will also photograph, thumbprint and photocopy the picture-ID of the individual being tested and send the samples to the directly to the laboratory for testing.

In order to establish the chain-of-custody, Genetic Identity will make all appointments for you in your area and pay all collection fees and shipping.  With over 2,500 facilities, we are able to make appointments for in your area. At the time of your appointment you will need to bring the following items in order to establish the chain-of-custody:

  • Photo identification for the adults such as a State driver's license
  • Social Security numbers
  • Birth certificates for the children if available

The accreditation program of the AABB has succeeded in ensuring the highest quality in for paternity testing. This consistent level of overall quality has resulted in the general acceptance of test results from AABB-accredited laboratories by the courts, without the need for expensive and time-consuming trials involving expert witnesses.

DNA Testing:
We have selected to use 16 alleles from the Identifiler™ kit.  The 16 alleles in this kit exceeds the requirements of several standardization bodies throughout world including the FBI. Thirteen out of the 16 alleles are approved by the United States Federal Bureau of Investigation (FBI) and are the alleles that are currently being used in their DNA typing database called the
Combined DNA Index System (1) (CODIS).
 

When we test a mother, child and alleged father using the 16 alleles system we are able to guarantee a minimum of 99.999% for the probability of paternity. If the alleged father is not the biological father (excluded), the probability of paternity will be 0%. 

If we only test the child and alleged father we are able to guarantee a minimum of 99.9% for the probability of paternity and 0% if the alleged father is excluded.

Sample Collection:
We use the most readily available source of DNA for paternity testing. The DNA we use for testing is located inside the mouth,
buccal cells. Genetic Identity’s will send our DNA collection kit to a laboratory in your area.  The DNA collection kits include foam tipped swabs and a FTA card. The foam tipped swabs are used to acquire buccal cells from the inside of the mouth.  The buccal cells are then transferred onto the FTA card. This procedure is painless and noninvasive.
